The bankruptcy code changed in fall 2005, and when it became more complex, many attorneys stopped offering bankruptcy services. Our office, however, has continued to counsel clients through bankruptcies - as we have for more than 2200 people over the past decade.

We file four different kinds of bankruptcies:

  • Chapter 7

    This kind of bankruptcy is also known as a "straight" or "liquidation" bankruptcy. In most cases, the debtor's home and automobile will remain safe. Many unsecured debts can be cancelled under this type of bankruptcy, but debts such as most taxes, student loans, and child support cannot be discharged.

  • Chapter 11

    Chapter 11 bankruptcy is for corporations. Under this type, there is a reorganization of debts and contractual obligations so that the company may try to stay in business.

  • Chapter 12

    This type of bankruptcy is available to farmers and fisherman who need to reorganize their debts.

  • Chapter 13

    Chapter 13 provides the option of reorganizing debts to individuals. This type of bankruptcy protects assets that wouldn't be protected under Chapter 7. It can also cure mortgage and auto arrears; other debts are consolidated under a three- to five-year repayment plan and may be lessened.
